TERMS OF SERVICE

  • Solarento - SOLARENTO Sp. z o.o. headquartered in Warsaw (address: ul. Puławska 2, 02-743 Warsaw), registered in the Register of Entrepreneurs of the National Court Register maintained by the District Court for the Capital City of Warsaw, 13th Commercial Division under KRS number: 0001135785, share capital: PLN 50,000.00, NIP: 5214091876, REGON: 54004431500000, being a party to the lease agreement of the Apartment for recreational or tourist stay with the Client,
  • Client – a natural or legal person who is a party to the temporary use agreement of the residential unit (lease agreement of the Apartment for recreational or tourist stay), managed by Solarento.
  • Apartment – an apartment, room, or house with residential function described in Solarento's offer presented, among others, on the website www.solarento.com, which the Client rents for recreational, tourist purposes or for a short stay.

§ 1 General Provisions

  1. These general terms of use of premises, hereinafter referred to as the Conditions, constitute an integral part of the lease agreement of the Apartment for recreational, tourist, or short-term stay concluded between the Client and Solarento.
  2. Under the lease agreement, Solarento undertakes to prepare and make the Apartment available on the agreed date in exchange for the agreed remuneration.
  3. Reservations of the Apartment can be made for a minimum period of 1 (one) day, unless the Apartment offer on the service states otherwise.


§ 2 Reservation of stay in the Apartment

  1. Before making a reservation and concluding the lease agreement, the Client undertakes to familiarize themselves with the content of these Terms and Conditions. Making a reservation of the Apartment is tantamount to accepting the Terms and Conditions (including the conditions of use of the Apartments and common areas of the building and adjacent areas). The condition for making a reservation may also be the acceptance of additional rules regarding a particular Apartment, presented to the Client at the time of making the reservation on the Service or another online portal.
  2. Reservations can be made using the IT system: via the website www.solarento.com or by phone at the number provided on the website www.solarento.com
  3. The Client making a reservation declares that they are of legal age.
  4. The current database of Apartments with detailed descriptions is available on the website www.solarento.com.
  5. Photos presented in the offer are for illustrative purposes only. In the Apartments managed by Solarento, signs of use may be visible resulting from natural wear and tear of the apartments and do not affect their usability.
  6. Booking a stay through the website www.solarento.com requires computer equipment or other electronic device with similar capabilities, meeting the following technical requirements:
    a) has Internet access,
    b) has an installed web browser (it is recommended to have the latest version of the browser, e.g., Internet Explorer, Google Chrome, Firefox, Safari, etc.),
    c) has an active and properly configured email account.
  7. During the reservation process on the www.solarento.com website, the Client selects an Apartment from the pool available for the given period and then makes the reservation by filling out the virtual reservation form available on the Service. The Client makes a reservation by indicating the specific start and end dates of the stay by selecting the aforementioned dates in the calendar provided by Solarento. The stay is counted in days.
  8. During the reservation process, the Client is obliged to provide information necessary to book the Apartment (in particular, first and last name, residential address, contact phone number, email address), simultaneously declaring their accuracy.
  9. After making an online or telephone Apartment reservation, the Client will receive a form with a link to the application sent to the provided email address, containing information about the reservation made.
  10. Each offered Apartment is intended for occupancy by a maximum number of persons indicated in the Apartment offer and/or the virtual reservation form available in the “Smart hotel” application.
  11. The number of persons staying in the Apartment is indicated by the Guest during the reservation process. This number may not exceed the maximum number designated for the given Apartment. A stay in the Apartment by more persons than indicated during the reservation, but less than the maximum intended for the Apartment, must be agreed upon directly with Solarento before the start of the stay and may result in an increase in the price of the stay or refusal of the reservation.
  12. The Apartment can be booked for a period of at least 1 day, which also constitutes the minimum duration of the lease agreement. Solarento reserves the right to set different, longer than minimal, stay periods depending on the stay date and the Apartment location.
  13. After making the reservation and before check-in, the Client is obliged to fill in and sign the electronic check-in form in the provided application. The link to the application containing the electronic check-in form is sent to the Client via email and/or SMS and/or a message using the mobile WhatsApp application. Failure to complete the check-in form will result in denial of check-in to the Apartment.
  14. By filling in the check-in form in the application, the Client is obliged to pay the spa/local tax. Failure to pay this tax will result in denial of check-in to the Apartment.
  15. Upon entering the Apartment, the Client is obliged to confirm successful check-in using the provided application.
  16. Successful reservation made by the Client via telephone or through the website solarento.com also means entering into an agreement under the terms set out in these Terms and Conditions.


§ 3 Payment Terms

  1. The rental price of the Apartment including additional costs is always provided in the reservation confirmation form received after making the reservation or by phone when making the reservation.
  2. For reservations where the stay in the Apartment is scheduled more than 14 days after the date of booking, confirmation depends on payment of a reservation fee of 50% of the order value within the term specified in the reservation form sent to the provided email address or phone number. The remaining value of the reservation must be paid by the Client no later than 5 days before the planned start date of the stay. Failure to pay the reservation fee within the time indicated in the form or payment within less than 14 days before the planned start date results in cancellation of the reservation. In case of doubt, the date of receipt of funds in Solarento's bank account is considered the payment date of the deposit and the remaining balance for the stay. In case of cancellation as referred to in this paragraph, Solarento refunds the full deposit to the bank account from which the deposit was paid or to the bank account indicated by the Client. Failure to pay the reservation fee within the time specified in the form causes cancellation of the reservation.
  3. For reservations where the start date of the stay is shorter than 5 days from the date of reservation, payment of 100% of the stay value within the time specified in the form referred to in item 5 is a condition of reservation confirmation. In case of doubt, the date of receipt of funds in Solarento's bank account is considered the payment date of the deposit and the remaining balance for the stay.
  4. If the stay is canceled less than 14 days before the planned start date, the Client is not entitled to a refund for the stay.
  5. The rental price of the Apartment includes:
    a) fee for preparing the Apartment,
    b) fee for the stay in the Apartment for the number of persons specified in the contract.
  6. The reservation price does not include insurance.
  7. When making a reservation, the Client can use discount codes offered by Solarento and its partners, as well as stay vouchers. Vouchers are a means of payment, and their use is not subject to any restrictions.
  8. The rental price of the Apartment does not include:
    a) additional cleaning during the stay,
    b) additional linen and towel exchange,
    c) crib rental,
    d) pet stay,
    e) parking cost - if parking space is not included in the Apartment offer,
    f) catering options
    g) and any other additional services.
  9. Payments can be made:
    a) by bank transfer to Solarento's bank account indicated in the reservation confirmation
    b) by BLIK payment, credit card, or electronic transfer via Przelewy24 registered under PayPro Spółka Akcyjna with registered office in Poznań at ul. Pastelowa 8, 60-198 Poznań.
  10. After payment, the system issues a proforma invoice with data provided during the reservation in the reservation form. On the day of check-out, a sales invoice will be issued.


§ 4 Changes and cancellations of reservations by the Client

  1. The Client may change the reservation up to 14 days before the planned arrival. The Client should contact the Reservations and Customer Service Department at the number provided on the website www.solarento.com.
  2. Changing the reservation date may result in a change of the original rental price.
  3. If changing the stay date is not possible, and the Client cancels the reservation less than 14 days before the planned start date or fails to appear at the Apartment at the reservation date, the Client is not entitled to a refund of the paid price for the stay.
  4. If the reservation has been paid with a Voucher, the Client has no right to cancel the reservation free of charge. Cancellation of the stay results in the loss of the voucher funds.


§ 5 Changes and cancellations of reservations by Solarento

  1. Reservation changes by Solarento are possible only in the event of force majeure that prevents Solarento from fulfilling its obligations. Force majeure means: natural disasters, seizure of the apartment by any governmental authority for any purpose, strikes, wars, riots, or deprivation by the Apartment supplier of electricity, gas, heating energy, or water. In such cases, Solarento is obliged to propose another date and/or apartment to the Client. Solarento may also withdraw from the contract, refunding the paid reservation fee to the Client.
  2. In exceptional situations (Apartment malfunction or other random events) Solarento reserves the right to provide a substitute property with parameters and area similar to the reserved Apartment. If the Client does not agree to the substitute Apartment, the contract is terminated, and Solarento shall refund the Client the paid reservation fee.
  3. Solarento reserves the right to cancel the reservation without giving a reason within 24 hours of making it. In case of cancellation, the Client will receive a refund of all paid amounts.


§ 6 Conditions of Client's stay in the Apartment

  1. The Client's stay conditions are specified in the Apartment stay Regulations.

§ 7 Contact details

  1. The Client can contact Solarento using the following contact details:
    a) Reservations and Customer Service Department at the number provided on www.solarento.com
    b) via chat available at: www.solarento.com
    c) via contact form available at: www.solarento.com/kontakt
    d) via the messenger within the electronic check-in form provided to the Client


§ 8 Withdrawal from the agreement

  1. In case of purchase of accommodation services via remote communication means (website, phone) or outside the company’s premises, the Client being a consumer as defined by Civil Code provisions may withdraw from the contract without giving a reason within 14 days from the date of conclusion of the contract, taking into account the provisions of Article 29 of the Consumer Rights Act. To do so, the Client should submit a statement of withdrawal.
  2. The withdrawal statement template is appendix no. 1.
  3. If the service is to start before the withdrawal period from the distance contract expires, the Client as a consumer is obliged to submit an explicit statement containing such a request when purchasing the service. If the Client exercises the right of withdrawal after reporting the above request, they are obliged to pay for services rendered until the withdrawal from the contract. The payment amount for the stay is calculated proportionally to the scope of services rendered, considering the agreed price in the contract. If the service starts before the withdrawal period expires, the Client is obliged to pay Solarento a proportional amount for services rendered until the moment the Client informed Solarento about the withdrawal from the agreement.
  4. In case of withdrawal by the Client from the Agreement, Solarento refunds the price paid by the Client within no more than 7 working days to the bank account indicated by the Client.
  5. Solarento, to the extent permitted by applicable law, is not responsible for failure to refund or delay in refund if the Client, despite the request, does not provide the bank account number for the refund or does not provide all data necessary for the refund. Moreover, Solarento is not responsible for failure or delay in refund due to providing incorrect personal data (name, surname, address) or incorrect bank account number by Solarento.
  6. Withdrawal from the agreement should be made by phone or email contact indicated in § 7.


§ 9 Complaints

  1. The Client has the right to file a complaint regarding stay conditions, service standards, and other factors.
  2. The condition for considering the complaint is to submit it in writing to the company headquarters address available on the website www.solarento.com or electronically to reklamacje@solarento.com.
  3. The complaint should include the reservation number and a description of the situation subject to the complaint.
  4. The complaint will be processed no later than 14 days from receipt. Information on the result of complaint consideration will be sent to the Client at the email address, mailing address, or by phone indicated by them.
  5. In case the complaint is not upheld, the Client retains the right to pursue claims under the general principles of the Civil Code.


§ 10 Limitation of liability

  1. Solarento is not liable for access difficulties to the booking system on the website www.solarento.com due to reasons beyond Solarento's control. Solarento may suspend access to the www.solarento.com service for the period necessary to remove technical and organizational obstacles.
  2. Solarento is not responsible for Client's property left in the Apartment, especially for its loss or damage.
  3. Solarento is not liable for any inconveniences that may arise during the Client's stay in the Apartment caused by reasons beyond Solarento's control, including interruptions in electricity, gas, water supply, as well as maintenance works in the building where the Apartment is located and in its vicinity.
  4. The Client agrees to provide true data necessary for reservation processing that allows identification of the person (incorrect or untrue data may result in the inability to provide necessary information for the stay). Solarento is not responsible for the inability to contact the Client before arrival if the Client provided false or incorrect data.


§ 11 Personal Data

  1. Solarento is the administrator of personal data processed in connection with Users' use of the Service and its functionalities.
